Abstract
Frequently human beings need a layer to enforce their rights. So would need enforcing animals rights: from this point of view all animal species are juridical equal. The base of the exercise of rights is Rousseau s assertion about being the judge of the means for self preservation. During the last decades countless ethological studies, as well as several philosophical texts, have shown that it is possible to recognize in some species such a judgment capability. Nevertheless, this capability is not taken into account by the theories of property on land - a coherent unity of living beings and minerals- proposed, respectively, by Locke, Kant and Hegel, which have a decisive influence in Western right. A reflection on the concept of citizenship provides a foundation to the right of some animals to decide on their own life on Earth, an Earth shared with human beings. Animals rights do not represent a break in the juridical system, but a part of its natural evolution. Keywords: citizenship; animal rights; private property over living beings.
